While ex-Controller Alan Hevesi gets set to go home from prison next month, his former longtime political consultant Hank Morris will remain behind bars.
Morris, the ringleader in a massive pay-to-play state pension fund scandal, was denied parole a second time after a hearing on Wednesday. That same day, Hevesi was told he will be paroled next month after serving months in prison for his role in the scandal.
"After a review of the record, interview and extensive deliberations, the panel has determined that if released at this time, there is a reasonable probability that you would not live and remain at liberty without again violating the law and your release would be incompatible with the welfare of society," the parole panel wrote.
Morris in March 2011 began serving a maximum four years prison sentence after pleading guilty to trading access to pension fund business to those who paid him lucrative fees. He was accused of raking in $19 million, a total he has since paid back.
He also arranged for those who donated to Hevesi's campaign to receive pension fund business.
The panel noted his? clean disciplinary record, "your sincere remorse", and rehabilitative efforts.
"Despite your superior education, political acumen, business savvy and success, mature age and advanced knowledge, you only superficially explored the legality of your conduct and failed to explore at all your ethical obligations as an attorney and broker," the panel wrote.
"You were all too willing to engage in a lengthy and repeated course of criminal conduct. Your repeated assertions of not knowing what your state of mind was for over a 2-year period during the crime is of grave concern for the board."
"While the board believes your sincere expression of remorse, your inability to understand your state of mind during your criminal conduct prevents a voidance of similar future conduct. Parole is denied."'
Morris, 59, serving a 11/3-to-4 year sentence at Hudson Correctional Facility in Columbia County.
He will next appear before the parole board in August for a third attempt to get out.
